Foreclosure Scam on Law & Order

Law and Order this evening included a storyline with a supposed example of how someone could take advantage of a homeowner in foreclosure by tricking them into signing over ownership of their property. In the show's example, the scammer was acting as a concerned rescue company that helped homeowners KEEP their home. He then had the homeowners sign a Quit Claim Deed which effectively gave all ownership of the property to the scammer. He stated it was just temporary to show the lender that the they were serious about resolving their foreclosure situation. He then went on to sell the property without the homeowners' knowledge. Connecticut 8th Highest Foreclosure Rate in the Nation

 

Connecticut ranked eighth in the country for highest foreclosure rates in January, including 3,697 properties with foreclosure filings. That's a nearly 185 percent increase from January 2007. 

The top 10 states with the highest foreclosure rates are: Nevada, California, Florida, Arizona, Colorado, Massachusetts, Georgia, Connecticut, Ohio and Michigan.  The number of homeowners facing foreclosure nationwide jumped 57 percent in January compared to a year ago, according to an Associated Press story released today.

Predatory lending is another term for loan fraud committed by mortgage lenders, home appraisers or real estate professionals on consumers who are trying to buy a home, obtain re-financing or make improvements on their home. A bad loan obtained from a predatory lender may cause homeowners to lose their chance to buy a desired home, lose the equity in their current homes or force them to sell their homes when they are unable to make loan payments. FORECLOSURE / AVOIDING FORECLOSURE

Failure to pay your monthly mortgage payments can lead to foreclosure, but there are ways to avoid that outcome. The following is a list of things you can do to avoid foreclosure.

  • Analyze your financial situation and calculate how much of your mortgage you are able to pay.
  • Contact a non-profit credit counseling agency for help with analyzing your financial situation.
  • Contact your mortgage company as soon as you realize that you cannot make a mortgage payment or soon after you have missed a payment – the sooner the better.
  • Stay in touch with your lender. Do not ignore the lender’s attempts to contact you.
  • Work with your lender to find a solution. Lenders are motivated to help you find a way to avoid foreclosure. They want to continue receiving your mortgage payments. They don’t want to own your house.
